What do people know about Search Results Specialists?

Premium Locals (see separate thread) has been taken over (morphed into) this business. This was announced last Friday.

Their website appears to use the name of a virus "search results". This is now live.

It has also been suggested that Tim Sabre who was involved with Publicity Monster is involved.

I'm keen to know what is going on. NSW Fair Trading has not been able to assist although they suggested I should lodge an online enquiry with Fair Trading which I have done.

Is Premium Locals simply attempting to avoid paying those who have received orders against them at NCAT?

Any assistance you can give would be gratefully received. I've got another hearing with Premium Locals and they have failed to lodge the documents with me that they will be relying on in the hearing and I suspect that they won't turn up so I won't get my refund.

Someone has just posted this on the Premium Locals thread. Very interesting re Search Results Specialists being likely to suck in a whole lot of unsuspecting new people.

"I have just been through the most drawn out procedure with NCAT and had no luck in the end getting my money returned. Premium Locals didn't show up at the hearing. I am now taking this up with my bank in the hope they will have better luck than I. Today I contacted Office of Fair Trading with an enquiry as to how these people can be stopped. The best answer they can come up with is if enough people lodge claims with them (Office of Fair Trading) they would be in a position to take it to the media. This company has now changed its name to Search Results so a whole lot of new unsuspecting people will be taken down and so it goes on. I can only suggest everyone Lodge your claims with OFT and also see your bank. I also hope this forum will help in altering others to this scam."

Stay away from Search Results! This company is nothing but a scam. They were once called Premium Locals and they ripped off a whole lot of unsuspecting people and now have changed their name so they could continue with their scam. If you have already given them your credit card details immediately cancel your card, do not give them any money!

Premium Locals in my experience were misleading and inaccurate in their sales pitch.

They also used imprecise language that 'muddies the waters' in terms of what they actually do for you.

They 'cold called' and asked to sign up over the phone- making a recording of the 'agreement' and referring me to online terms and conditions- except they weren't on their site. After I lodged a formal complaint with relevant authorities a tiny link at the bottom of their page magically appeared!

They didn't provide any written documentation about what services or the content of the package was, despite many requests. The best I got was 'you get 10 key phrases'.

I suggest that if you are silly enough to want to engage the services of Search Results Specialists Pty Ltd then:

1. Ask them to email you a written agreement you can review before signing up including all terms and conditions to be relied on as part of the agreement.

2. Ask them to email you a complete itemised list of what services are included in the package and the amounts/units included in the agreement- dont let them say 'website optimization' ask them specifically what this involves and how often it will happen.

3. DO NOT rely on any verbal agreement, ensure EVERY contact with them is via email.

It appears that the people behind Search Results Specialists are the same people responsible for Premium Locals. Whatever you do, don't give Search Results Specialists any money and certainly not your credit card details. If by some chance you have already done so, you can get out of it if they telemarketed you. In this case it is an 'unsolicited consumer agreement' and you are entitled to a 10 day cooling off period. If they do not inform you of your right to a 10 day cooling off period it is extended to 6 months. So far people have had the best results when they have put it in the hands of their bank to reclaim their money.
We were telemarketed by them 4 months ago and stupidly gave them our credit card details before doing a reference check on them. The first person that I spoke to who they had given as a reference told us not to deal with them. Unfortunately it was too late so we rang our bank and cancelled our credit card. We then started the process of a 'transaction dispute' because they had taken our money before the 10 day cooling off period (in fact they had taken it as we were on the phone to them). It took 3 months but we have reclaimed the $4015 they took.
They will tell you that you have a 'business to business' contract with them and even direct you to parts of the ACL law that sound convincing but it is not correct. You are the consumer of the product that you purchased and if they called you, then it was an unsolicited call. Fight it out, it's worth it to get your money back.

This company – Search results specialists pty ltd Abn : 91150100351 is sending out fake invoices and hijacking Google Maps usernames and passwords from businesses and doing this by deception saying they need it to rank you on the front page of google then they change the password without your authority and take over parts of your business. ABN Business registrations the ATO has also been informed and google will be informed of this fraudulent behaviour. Merged with premiumlocals.com who have frauded many Australian company's which i believe is now de-registered. Using offshore call centres to ramp up there deciet. Please look into this company who has decieted our company and many others as we are hard working and honest small bussinesses who cannot afford to lose thousands like this. copy and paste to all government agencies as we speak ASIC,ACCC,GOOGLE and those above. These dishonest people will be exposed ! If you have been signed up cancel credit cards immediately

Interesting fact, Fish PC got shut down due Apple's complaints about them selling iMac imitation knockoffs and Microsoft for wrongfully promoting they were endorsed by Microsoft.

In the PM thread we speculated back in December that Premium Locals and PM were the same company. Their MO was so similar but it couldn't be definitively proven. A bit clearer now.

I've just paid a deposit (stupidly) then find out that it's a scam. They are now threatening debt collectors and if I still don't pay legal action. They say it's a business to business contract over the phone with no cooling off period. Told them to send it to debt collectors, they then said they didn't want it to come to that and can we work something out. Got my bank on to it they said they will retrieve my money. Anyone know if they can legally take action against me?

So today after a long morning discussion with Phillip Phram i was told i had no chance of winning against Search Results Specialists in a tribunal. So now i have notified my bank, NSW Fair Trading and the ACCC which have all taken statements. Tomorrow i lodge my complaint with the NSW Civil and administrative tribunal.

So now they cannot back up what i was originally offered which was to come up at the top of the search engine in my area for the trade in which i work. Now i don't even have a website, only a listing on yellow pages.com.The Website was going to be thrown in for free with this offer for $1998.00 plus GST. They said if i did not take this opportunity they would ring the next business in my area of trade and offer the deal to them as it is first person in first person served as only 1 business can have the top advertisement in the search page over a 12 month period.

So another phone call this afternoon to Phillip Phram, i asked if Search Results Specialists were once either Premium Search Results or Publicity Monster, to which he replied he knew of these companies but in know way affiliated or associated with their business dealings.

After some heated discussion he asked me on what evidence i had to take their company on at the tribunal. He said obviously i have been reading the whirlpool forums and would i believe what people post on the internet. Well Phillip Phrap 350 pages with web links to various media resources.

I then responded with the article about 92 cases in the Victorian tribunals where 91 of those were settled out of court. ( This was when the company was previously named Publicity Monster). He then said they were settled out of court as they were a company with the means to meet peoples demands and expectations

I then replied so you were once known as publicity monster, following a pause to which he replied "I said we had nothing to do with Premium Search Results". After i said what i thought about his ethics, he congratulated me on originality and said "do you not think that i don't put up with this abuse all day?", Well obviously with the amount of disgruntled clients i can only imagine.

Good job. I'd recommend that before you put in the tribunal you consult a lawyer and get legal advice. Make sure you do it right first time and you make a valid claim.

And the company you were thinking of was 'Premium Locals' which we suspected was PM rebranded but couldn't really prove it until recently. Actually the fact that WP users started up a separate thread complaining about the same things for Premium Locals validates the PM thread if nothing else.

If you have been scammed in last 6 months or so I recommend you submit dispute with your bank if you used visa card to pay. I submitted dispute form with my bank and they have transferred the money back to me. So glad I didn't have to go through the NCAT process.

I have just posted this on the Premium Locals part of the Forum. Relevant now that Search Results Specialists have taken over Premium Locals....

Today is the anniversary of my signing up with Premium Locals. And today is the day I have received orders from NCAT in my favour giving me a full refund of monies paid by me for services which were never received.

I have been told by NCAT that if Premium Locals does not pay up as ordered I will need to go to my local Courthouse which will then attempt to recover the refund ordered to me.

I have advised Premium Locals / Search Results Specialists that if they make any further deductions from my credit card I will complain to the NSW Police (Fraud Squad).

If you have been cheated as I was, I encourage you to not give up. But it does take a huge amount of time that most small businesses don't have. I am fortunate that I am retired so I had the time to put into this. And I am married to a solicitor so I was able to put my case thoroughly and she was able to come with me to the three NCAT hearings.

Unfortunately taking action is an arduous process. I first lodged my Application to the Tribunal last December and I've had no less than three mornings in the Tribunal averaging about two hours each. I also had to put a comprehensive binder of documents together for the final hearing this week. This is not easy without legal advice.

My objective was to demonstrate to Premium Locals that this model of cheating people is not worth the effort. So I wanted to cause Premium Locals as much inconvenience and cause them to incur expenses at least equivalent to what I believed they had cheated me of, even if I didn't win a refund. I'm sure I successfully did this as the two earlier hearings involved them paying a contractor to appear for them and prepare for these hearings and provide documentation to me. (Mr Chidiac who appeared for Premium Locals at this week's hearing may be an employee on the other hand.)

In my case I was lucky that Premium Locals did not comply with the orders of the Tribunal last April to submit any documents they intended to rely on at the adjudication. So while a Mr Chidiac did represent Premium Locals at the final hearing this week for the Member's Orders, he had no documents or evidence to rely on.

Interestingly, Mr Chidiac said he was their Customer Service Manager (yes, apparently they have one of these even though many of us didn't get any service).

Importantly he swore on oath that Premium Locals still does exist. So hopefully this means that I will be able to get the refund I was ordered.

Mr Chidiac did attempt to woo me into continuing a relationship with Premium Locals (I claimed I had ended the contract last December) by offering a money-back guarantee of specific SEO results with an additional year of service. But I refused this offer.

I expect that the Orders made in my case will be posted shortly on the NSW Case Law website http://www.caselaw.nsw.gov.au/nswcat/index.html (my case was GEN14/11499).

As advised by others I have listed my payment to Premium Locals as a disputed transaction with my bank. But I only did this recently almost a year after I made the payment. I gather you have some years to do this and clearly this is worthwhile.

I'd better get on to NSW Fair Trading as NCAT case outcomes are not automatically notified to NSW Fair Trading as they are now separate bodies. Also I will notify the ACCC as I had previously reported Premium Locals to them. I encourage others to do this if you too have been cheated. We have to stop people like this operating to scam people.

Amen to that – not many people have the nerve, or time to fight these matters, so congratulations on your win. I can see other companies who deceive their customers facing a few tribunals in the future too, but the main thing to remember is, if you haven't signed ( well, OK thats gone now) or pinned for your purchase you can always get the money back from your bank- whether a company pursues later for the funds, is another matter, but as they say, possession is 9 tenths of the law, so I'd be taking my chances

I am currently fighting to get a refund from these guys. Have just disputed the transaction with my bank. When I told them this, Adam Chidiac, their Customer Service Manager, threatened to have criminal charges filed with the police against me if I followed this course of action.
They even have a clause in their terms and conditions along these lines.
Just reading this in the T & Cs should have people very concerned about this company.

They have done same thing to me. They have been threaten me and hassling me non stop to withdrawn my bank dispute. They said its fraud and a criminal offence to submit a bank dispute.
I think they are trying to scare us as they know if we submit bank dispute they have no chance in keeping their money. Whereas most people that have gone through NCAT and have won still havnt received their money and have to take further actions to try and make them pay it back even though they have won.

How do they get a name like this registered (recently it seems) when there is a well-known business with a very similar name.

I have now established that there is absolutely no relationship whatsoever between the two businesses with such similar names. I can't believe that Tim Sabre was allowed to register a business name so close to that of another quite successful business (which I gather is now being harmed by the similarity of the names). Sounds like there may be grounds for a passing off action to me.

Very interesting thread. They're chasing me for money at the moment saying that I'm liable for an "automatic renewal" of my contract with them.

I had that Phil wanker chasing me about it in January (and yes I can confirm his email signature back then definitely said he worked for "Publicity Monster")

I didn't pay and thought they went away. Now I have a Skye Terza ringing up pretending she's a lawyer (although careful to stop short of saying so).

I did offer her a few hundred bucks to piss off and leave me alone (which she rejected) but after seeing how many people are actually winning their cash back at NCAT I won't be giving them anything. I might even join the cause and fight for my earlier payment back from the previous year.

Is there a particular person at NCAT who's handling all these complaints?

Hi, a month ago i received a call from a guy named Pete on the 5th of November. Pete offered my small business a number 1 ranking on Google and a website. he sent invoices and also an email with key words to get it started, and said that i would be the only trade of mine that they will deal with it was $2400 for the year and i told me if i dont do it in 48hrs that they would find someone else. im a new small business trying to make some money so it all sounded good. i did a quick Google search and it all seems to be legit. however i then found out that it was a scam.

i should also ad, that there was no mention of a call down period and i told him i didn't have any money and he said "that is fine i will work something out" i then did a voice recording that he persuaded me to do. then wanted the whole $2400 up front, i could only pay $100 then the following week i paid $1200. i have now told Pete that i don't have any money and he said "i will have to get account to suit it out then, They can be ruthless compared to dealing with me"

i have now contacted my bank and filled out a form and i also filled out a form for fair trading.

Is there anything i should do? Anyone got any new news with there fights with them? i just need help, i'm stressed i don't have money and i cant believe i got scammed. Any help at the stage is good help.

We just won our case against SearchResults, formerly Premium Locals today. We'd signed up with them during a very stressful time last year and only wanted a one year contract with them. I was assured we would be given plenty of notice re renewals and that it was easy to cancel. Neither happened. I received a very dodgy renewal notice that was emailed out and looked like spam: no salutaion to me, no name on it to contact, no account number or details, no phone number, sent from a suport@XXX email address, no date; just a blurb re if there was no response then auto renewal would take place. Obviously I thought it was spam and ignored it. You get at least 2-4 of these a month in small business.

Next thing I saw $2475.00 going out of my account and I contacted the bank immediately. The payment was reversed and I cancelled the card. I had tried contacting SR as they advertise 24/7 contact and got hold of a dodgy sounding Filipino call centre for their accounts but that was a dead end and they could do nothing. SR are not availbale on the weekend.

Then the phone calls and high-pressure harassment started. They called me several times a day and stressed me and my staff out. This went on for a week or so. I was threatened, told debt collectors would be calling etc. Some online research lead me here and I lodged a complaint with NSWCAT (after talking to numerous other agencies). I followed the advice posted earlier with all the registered office details. When you lodge your complaint use the registered office address not the street address SR trade from. The notice must go to the registered business office to be legal/valid.

There was some issue whether NSW was the palce to lodge – I am in QLD, they are in NSW and the contract was made over the phone – but the jurisdiction was accepted to be covered by NSWCAT. As I did not list the registered address initially a notice was sent to the trading address of SR by NSWCAT and at the first phone hearing SR did not show up. The mediation was ajourned and a new notice was sent to the registered address of SR. I had initailly applied on line but was also advised that I needed to mail in hard copies of the invoice and renewal that had been emailed to me by SR. The second hearing/mediation session was today and again they did not attend. It was found in my favour and the matter is now settled.

If you go to NSWCAT or other appropriate tribunal you will win, it just takes time. As the amounts are bleow $40,000.00 it can be heard as a consumer complaint which means you have far more rights. I had received some advice to say that the contract was valid and if I had listened to that advice I would be out of pocket and still dealing with SR.

In addition to stating that I was never given T&C by them, that they changed names and T&Cs without contacting me (goes against the conditions in which a contract is formed as I understand it), their whole conduct is designed to bully/pressure you into a rolling contract with the sole purpose of mulcting you: below is a an excert from what I sumitted

The notice I found looked like spam; I’ve worked for myself now for a bit over 5 years and every month I get 1-3 fake requests for payment or other dodgy requests and this fit the profile:
1. sent from support@XXXX email address. not accounts@XXXX and not a name@XXXX
2. no salutation. my name appears nowhere on it
3. no name of any employee on it. who sent it? who authorised it? who is responsible for collections?
4. no phone number or address to follow this up
5. no date for when the renewal should take place. when does the contract end?
6. no details of the service, what is provided, no account number/reference number/billing number/tracking code
7. no real info on what to do to cancel, no links to main website, details of my account etc etc
8. didnt recognise the name of the company

There was nothing sent to me in the mail in writing and I have had no follow phone calls since the initial cold calling to see how everything is going, if I am happy with the service and if I want to renew. I was never sent any of their service information; when I signed up originally I was on plan C. I have no details of exactly what that was other than their top service. I do not need on going SEO but if I did then I certainly do not need a top plan as most of the initial work has been done and now it’s just maintaining it which requires far less effort by comparison.

Yes as I am in QLD I have found it difficult also. The issue I have is my bank believed me and did not give them any money so I am not actually out of pocket – however they keep sending me renewals which are accumulating debt against me and now I have had the debt collectors send me a letter and they told me today that SR have lodged a fraud case with NSW police against me. I SO WISH they would just drop off the side of this earth I don't need their BS stress

I have been refunded the full amount after two NCAT hearings. On the second hearing they never showed up. NCAT awarded me a full refund from Premium Locals and after sending them an Examination Notice, Search Results refunded. I was doubtful whether I would ever receive any money so was pleasantly surprised. The wheels do turn slowly but persistence is the name of the game.

Perhaps the most ridiculous company I have ever dealt with. No organisation, sloppy customer service, over stating and over pricing.

Do not waste your money on this lot. Their business model is to simply scam you for at least two years and not provide and service. That is there business seriously scam at least two years. Close up shop and restart another company.

Our authorities are not equipped to deal with these types of swindlers. They would sell their own mother to make a profit.
